L’articolo, muovendo dalla critica di Bobbio all’istituzionalismo e alla concezione analogica del diritto e dell’istituzione di Renard, riprende la questione del nesso tra istituzione, testualità e immagine, individuando in questo plesso problematico comune alla storia teologica, giuridica, artistica dell’Occidente nuovi elementi per la riconfigurazione della nozione, ai tempi della globalizzazione e dopo la secolarizzazione della Religione, ma anche dello Stato. L’idea moderna di istituzione, oggi, preso congedo dal normativismo positivista novecentesco e dagli ideali a esso legati di purezza teorica della riflessione giuridica, si apre così , non senza rilevanti problemi di coerenza, a una visione più ampia. Essa tiene conto di nuove (eppure assai risalenti) accezioni del fenomeno istituzionale, quali quelle emergenti dal pensiero economico e della teoria dei media; ma anche estetiche ed ermeneutiche, interne alla storia giuridica del Corpus Iuris su cui si è edificato l’Occidente.

The paper, moving from Bobbio’s criticism both of the institutional theory of law and Renard’s Thomist conception of legal analogy, looks at the relationship between institution, textuality and image. Taking into account the common theological legal and artistic history of the West the paper identifies new elements for the reconfiguration of the notion of Western legal culture, the secularization of religion, but also of the state. The modern notion of institution, today, having abandoned twentieth-century legal positivism, moves toward, not without serious problems of consistency, a broader theoretical vision of the law. It takes account of new (yet very dated) meanings of institutional phenomenon, such as those emerging from the economic thought and theory of the media, but also from aesthetic and hermeneutical elements internal to the legal history of the Corpus Juris on which the Western tradition is built.
